Terms & Conditions – Image & Video Licensing & Usage

1. General Licensing

All images and video (“assets”) purchased from The Queensland Imagery Library are supplied under a general usage licence. This licence grants the purchasing organisation ongoing, non-exclusive rights to use the asset for internal and external communications, marketing, advertising, and general promotional purposes.

General licences are not time-limited. Once purchased, the buyer may continue to use the asset indefinitely under these terms.

2. Permitted Users

Assets licensed under general usage are granted to the purchasing organisation and its internal team only. They must not be forwarded, transferred, sublicensed, or provided to any other entity, organisation, or third party for their use.

If another organisation wishes to use the same asset, they must purchase their own licence or request a buy-out quote.

3. Exclusive Rights & Buy-Outs

If you require exclusive rights to an image or video, a buy-out price must be confirmed and agreed to by all parties prior to the asset being removed from The Queensland Imagery Library.

Before finalising a buy-out, Market to Market Communications will advise whether the asset has been previously purchased or used by other entities. If prior usage has occurred, those earlier buyers will retain their existing rights to continue using the asset under the original licence terms.

Exclusive rights apply from the date of purchase forward. Once the buy-out is completed, the asset will be removed from the library and will not be sold again.

4. Copyright Ownership

All images and video remain under copyright ownership of Market to Market Communications and the contributing photographer or videographer.

Purchasing a licence or buy-out grants usage rights only. Copyright is not transferred unless explicitly stated in a separate written agreement.

5. Prohibited Use

Buyers must not:

● Resell, trade, or redistribute assets to any third party

● Claim ownership or authorship of the asset

● Use the asset in any way that breaches copyright, privacy, or applicable laws

● Alter the asset in a manner that misrepresents the original creator’s work (reasonable editing for marketing purposes is permitted)

6. Delivery of Assets

Assets are delivered via downloadable link within 12-24 hours of payment. A receipt will be issued upon completion of the transaction.
